July 2007 Special Meeting

Pursuant to a notice duly filed with the Town Clerk, a special meeting of the Concord Retirement Board was held at 8:30 a.m. on Tuesday, July 10, 2007 at the Town House, Concord, MA.

Present:        Peter Fulton, Chairman
Tony Logalbo, Appointed Member
Arnold Roth, Appointed Member
Brian Whitney, Elected Member
Gail Eagan-Henry, Ex-Offico Member
Also Present:   Linda Boucher, Retirement Administrator

After reviewing the Agreement for Redeeming Liability by Lump Sum Under G.L. Chapter 152 for injuries occurring on or after November 1, 1986 as it relates to Alan Shattuck, Tony Logalbo made a motion to accept the terms of the Lump Sum Settlement as indicated on the Department of Industrial Accidents Form 117 and consented to by the board’s counsel, Tom Gibson.  The motion was seconded by Brian Whitney.  Voted unanimously.    

The Regional Medical Panel Certificate for Benjamin Breault was presented to the board for approval.  Tony Logalbo made a motion to grant ordinary disability retirement to Mr. Breault and to forward the medical panel findings to PERAC for review and retirement calculation.  Arnold Roth seconded the motion.  Voted unanimously.

At the May 30, 2007 board meeting, a status update of Jason Gaspar’s application for accidental disability was conducted.  After some discussion, the board concurred to seek legal advice from counsel, Tom Gibson.  Attorney Gibson provided the board with his recommendations.  At this juncture, recognizing the objective to move forward, Tony Logalbo made a motion to accept Jason Gaspar’s application for disability retirement and to forward the application to PERAC requesting a medical panel evaluation.  Brian Whitney seconded the motion.  Voted unanimously.

The meeting adjourned at 9:30 a.m.
