Public Hearing

On Tuesday, March 3, 2015 at 7:00 p.m., the Concord Planning Board will hold a public hearing at the Town House Hearing Room located at 22 Monument Square, pursuant to M.G.L. Chapter 40A, Section 5, concerning Zoning Bylaw amendments proposed under Articles 11 -18 and an alternative Planned Residential Development proposed under Article 19 in the 2015 Annual Town Meeting Warrant.

Article 11      Boarding House Section 4.2.8 – change the definition to be consistent with a specific State statute.
Article 12      Lot Width Section 6.2.5 – add language to clarify lot frontage requirements when applying Section 6.2.5 Lot Width.

Article 13      Earth Removal Section 7.5 & Personal Wireless Communication Section 7.8 –incorporate reference to the Town’s Wetland Bylaw.

Article 14      Wetland Conservancy District Section 7.3.1 Definition and Section 7.3.2 Purpose –bring the definition and purpose into conformance with the Town’s Wetland Bylaw.  

Article 15      Residential Cluster Section 9.2.4 – add an upland requirement to the area of required open space and incorporate reference to the Town’s Wetland Bylaw.  

Article 16      Planned Residential Development Open Space Section 10.2.9 & Section 10.3.4.2(a) Preliminary Site Development and Use Proposal – add a reference to the Town’s Wetland Bylaw and correct a section reference.

Article 17      Residence A & AA Building Height Section 6.2.11 Height & Table III Dimensional Regulations – change the method for measuring height of a structure in the Residence A and AA Zone Districts.  

Article 18      Residence A, B & C Floor Area Ratio Definitions & Dimensional Regulations – add a new Floor Area Ratio requirement in the Residence A, B and C Zone Districts.

Article 19      (By Petition) Black Birch Alternative Planned Residential Development – a 25-unit over age 55 residential development on Lot 6F and Parcel 6B Forest Ridge Road.

Planning Board Charge

The Planning Board consists of seven members, appointed for five-year, staggered terms by the Selectmen. By reason of Chapter 40A, all decisions as special permit granting authority shall require a two-thirds vote.

It shall be the duty of the Planning Board to investigate all petitions calling for a variation, modification, change, or extension of use under the Zoning Bylaw and to report its recommendations thereon to the Board of Appeals.

It shall be the duty of the Planning Board to conduct investigations respecting proposed amendments to the Zoning Bylaw appearing in the Warrant for any Town Meeting, and to present its recommendations to the Town for consideration at such Town Meeting. The Board of Selectmen shall cause the Planning Board to be notified of all such proposed amendments.

Subdivision Rules and Regulations set forth the Planning Board's procedures and standards to be followed in the subdivision of land and the construction of ways. The Concord Planning Board is authorized under the General Laws of Massachusetts to regulate the laying out and construction of ways in subdivisions to insure the safety, convenience and welfare of present and future inhabitants of Concord. The Board shall exercise its authority with due regard for the provision of adequate access to all of the lots in a subdivision by ways that will be safe and convenient for travel; for lessening congestion in such ways and in the adjacent public ways; for reducing danger to life and limb in the operation of motor vehicles; for securing safety in the case of fire, flood, panic and other emergencies; for insuring compliance with applicable provisions of the Concord Zoning Bylaw and the Wetlands Protection Act; for securing adequate provision for water, sewerage, drainage, underground utility service, police and fire protection and other requirements where necessary in a subdivision; for coordinating the ways in a subdivision with each other and with the public ways in neighboring subdivisions; and for preserving the special historical and rural character of Concord.
